Background

The Office of the Legal Advisor was initially known as the Legal and Disciplinary Unit and was established in 2007 when UTeM was formerly known as KUTKM. The Legal and Disciplinary Unit was placed under the responsibility of the Registrar's Office and later upgraded to the Legal Division with two (2) units, namely the Drafting & Legal Unit and the Disciplinary Unit.

In 2010, the Legal Division was upgraded to the Office of Legal Affairs and placed under the Chancellery Office. Finally, in 2016, the Office of Legal Affairs was rebranded as the Office of the Legal Advisor with five (5) functional divisions, namely the Advisory & Consultation Division, the Drafting Division, the Legal & Legal Research Division, the Contract Management & Compliance Division, and the Integrity & Administration Division.

Starting from May 2023, the Office of the Legal Advisor has operated four (4) functional divisions, namely the Advisory & Consultation Division, the Drafting Division, the Legal & Legal Research Division, and the Contract Management & Compliance Division. Currently, the Office of the Legal Advisor has twelve (12) staff members led by Mr. Mohd Nizam bin Pavel, the Legal Advisor, and assisted by four (4) officers and six (6) supporting staff. Beginning in September 2023, a rebranding of the divisions was carried out, and the Office of the Legal Advisor can be classified from the combination of four (4) divisions, namely:

  • Advisory Division
  • Corporate Drafting Division
  • Claims & Legal Division
  • Procurement Management & Contract Administration Division

Function

  1. Administer and manage legal matters handled by the panel of lawyers, especially for litigation issues and proceedings;
  2. Draft, review, and conduct negotiations related to legal documents including, but not limited to, Memoranda of Agreement, Memoranda of Understanding, and others involving the University;
  3. Assist in advising on staff and student disciplinary matters;
  4. Assist in drafting and amending the Constitution, Statutes, Rules, Regulations, policies, guidelines, and other related documents pertaining to UTeM;
  5. Manage cases of contract breaches such as:

    - Scholarship Agreements;
    - Notices of resignation before maturity;
    - Lease Agreements; and
    - Procurement Agreements
  1. Monitor the implementation of contract management and compliance through the Contract Management & Compliance System (SPPK) and Contract Compliance Audits;
  2. Administer and handle the stamping of the University's legal documents and monitor Stamp Duty payments to the Inland Revenue Board (LHDN).
